Is it 'Maintenance' - or an 'Improvement'?

When a Body Corporate wants to spend money on a Common Property issue, it needs to determine whether that expenditure item is classed as being for ‘maintenance’, or is it actually an ‘improvement’ to the Common Property.

Sometimes this distinction can be tricky - as this explanatory document from the Body Corporate & Community Management Commissioner illustrates. It isn’t only defined in the legislation, but Adjudications have been necessary to provide further guidance.
